Wong Wing - Celebrate Chinese New Year in China Contest (the “Contest”)

OFFICIAL RULES

 

 

 

1. PROMOTIONAL PERIOD: The Contest starts at 12:00 am (ET) on January 2, 2012 and closes at 11:59 PM (ET) on March 2, 2012 (the "Contest Period"). A Contest Day starts at 12:00 AM (ET) and ends at 11:59 PM (ET) (a "Day"). The Contest closes at 11:59 PM (ET) on March 2, 2012 (the “Contest Closing Date”).
2. ELIGIBILITY: To be eligible for the Wong Wing – Celebrate Chinese New Year in China Contest (the "Contest"), an individual herein defined as an “entrant” must: (a) be a legal resident of Canada; (b) be located in Canada; (c) have reached the age of majority in his/her province or territory of residence at the time of entry; and (d) have and use only one valid email address to participate in the Contest. Employees, officers, and directors (including members of their immediate families and any other person living in the same household of such person whether related or not) of McCain Foods Limited ("Sponsor"), its affiliates (including, without limitation, its parent, sister and subsidiary companies), the independent contest organization, advertising or promotional agencies and suppliers of materials or services related to the Contest are not eligible to enter the Contest. For these Official Rules, "immediate family" means mother, father, sister, brother, son, daughter and spouse, including common law spouse, regardless of where they reside. Subject to applicable laws, the decisions of Sponsor and/or independent contest organization are final and binding in all matters related to this Contest and the awarding of the Prize. Groups, clubs, organizations, businesses and commercial and non-commercial entities cannot participate.

 

The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right, in its sole discretion, to disqualify any entrant, should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information or has not otherwise complied with these Official Rules.

NOTE: To enter the Contest you will require the UPC number from any of the participating products listed below. Simply purchase any participating product or if you prefer to not purchase a product hand write the UPC code while in the grocery store.

4. HOW TO ENTER: No Purchase Necessary. Visit www.wongwingpromo.ca and select a language. Note: To participate in this Contest you will require the UPC number from any of the participating products listed in Rule 3 above. Simply purchase any participating product or if you prefer to not purchase a product hand write the UPC code while in the grocery store.

a)    Select “Enter a UPC now”;

b)    Enter the 12-digit UPC code from a participating product, click “Enter”;

c)    Complete the on-line entry form with your first and last name; complete mailing address including postal code; telephone number including area code; enter and confirm your email address; enter the characters within the image area; tick the box as having read and accepted the Official Rules; indicate if you would like to start receiving future e-mail updates and communications from the Sponsor (not mandatory for entry); and select “Finish”;

d)    Upon receipt you will receive a “Thank you” message.

5. LIMIT OF NUMBER OF ENTRIES:  A limit of one (1) entry per Day per person. A person may only use one (1) e-mail address in the Contest. A person may only use one (1) first and last name, telephone number, postal code, one (1) e-mail address to participate in the Contest. Any person who is found to have entered the Contest with more than one (1) first and last name, telephone number, postal code and one (1) e-mail address or more than once per Day will be disqualified and all such entries received by such person during the Contest Period will be disqualified and no prize will be awarded to such person. Proof of transmission (screenshots or captures etc) does not constitute proof of delivery. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. The Sponsor will not be responsible for late, lost, illegible, falsified, damaged, misdirected, mutilated, garbled or incomplete entries, which will be void. All entries become the property of the Sponsor upon receipt and none will be returned.
6. PRIZE: There will be one (1) Prize (the “Prize”) available to be won. The Prize consists of a ten (10) day, nine (9) night trip for two (2) to China including two (2) return economy airfare tickets departing from the Canadian International Airport closest to the winner’s residence and arriving at Beijing Airport; nine (9) nights hotel accommodations (based on double occupancy in one (1) standard room at a moderate class hotel plus daily breakfast) with stays in Beijing, Xian and Shanghai; economy air transfers between those three (3) cities; return transportation to and from the hotel and airports in China; daily organized tours and attending one (1) local Chinese New Year event in one of the three cities. An example of your trip, actual agenda to be confirmed:

Day 1: Arrive in Beijing, transfer to hotel and the rest of the day is at your leisure.

Day 2: Tour of the world’s largest city square Tian’anmen Square; National Museum; explore Beijing hutong neighbourhoods by pedicab; a walking tour of Houhai Lake District.

Day 3: Visit Mutianyu Pass of the Great Wall; stop by 2008 Olympic site.

Day 4: Visit Temple of Heaven and Summer Place with an afternoon of leisure.

Day 5: Board a flight to Xian; visit the City Wall; Big Wild Goose Padoga with an afternoon of leisure.

Day 6: Visit the Terra Cotta Warriors and Great Mosque ending with a Tang Dynasty dinner and show.

Day 7: Visit the underground Hanyangling Museum and then board a flight to Shanghai with the remainder of the day of leisure.

Day 8: Full day tour of Shanghai city including an ERA acrobatic show.

Day 9: Visit Zhujiajiao with an afternoon of leisure.

Day 10: Transfer to the Airport for your return home.

     

Approximate retail value of the trip is $15,000 CDN based on a Toronto, ON departure. Actual retail value may vary depending on the departure city. The Winner and his/her guest must be available to depart from Canada sometime between February 2, 2013 and February 8, 2013.  Reservations will be accepted based on space availability and must be booked a minimum of one hundred and twenty (120) days prior to the departure date. The winner and his/her travel guest must each have proof of valid travel documents such as passports and visas prior to ticketing. The winner and his/her travel guest must be Canadian residents to qualify for the Prize. The winner and his/her travel guest must travel on the same itinerary. The winner and his/her guest must ensure they have the proper and required immunizations to enter China. The winner and his/her travel guest must have the right to enter China. Once the date of the trip has been confirmed, no alternative travel date or changes are permitted.  A minimum of one (1) person, either the Prize winner or the travel guest, must hold a valid credit card to cover any incidentals or any other requirement that may be required at any of the hotels. The Sponsor does not make any representations or warranty regarding the Prize. The Sponsor is not liable if the winner and/or his/her guest is refused access to a plane, entry into China, or re-entry into Canada. If, for any reason, travel is delayed, impeded or refused by the Canadian or Chinese authorities, Prize may be forfeited (in whole or in part) and winner and/or his/her guest will be responsible for any additional expenses incurred. Ground transfers to and from the winner and/or travelling guest’s residence and designated airport and all other expenses not specified herein, including but not limited to telephone or fax, hotel expenses and in-room expenses, gratuities, optional tours, taxes and fees, meals and beverages (which are not included in package), insurance, medical travel documents, personal expenses, and any other costs not specifically stated herein as being included, are the sole responsibility of the winner and his/her guest. No extensions will be permitted. The Sponsor reserves the right to offer a comparable product in the event of a vacation package cancellation, Act of God or other unforeseen circumstances. The Prize winner shall not be entitled to receive, in cash, certificate or otherwise, the balance of any amount representing the difference of the Prize retail value and actual cost. No frequent flyer miles will be available. The Prize must be accepted as awarded without substitution and is not transferable or for resale and has no cash surrender. The Sponsor reserves the right, in the event that the Prize or any component of the Prize cannot be awarded as described for any reason, to substitute a similar Prize or component of equal or greater value without liability.

7. DRAW: A random draw will be held to award the Prize from all eligible entries received by the Contest Closing Date on March 19, 2012 at 10:00 AM (ET) in Oakville, ON. Odds of being selected for the Prize will depend on the total number of eligible entries received on or before the Contest Closing Date. The selected entrant will be contacted by mail/courier or telephone within ten (10) business days of the Draw Date. In the event that the selected entrant cannot be contacted within ten (10) business days by mail/courier or telephone, the selected entrant will be disqualified, and his/her entitlement to receive the Prize will be forfeited and an alternate eligible entrant will be randomly selected from the remaining eligible entries received and the above process will be repeated. As a condition of being declared a Winner the selected entrant must first correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question to be administered by mail/courier or telephone at a mutually agreed upon time. In the event that the selected entrant incorrectly answers the mathematical skill-testing question, he/she will be disqualified and another entrant will be randomly selected and the above process will be repeated. This process will be repeated until such time as there is one (1) confirmed Winner (the “Winner”), and/or no more eligible entries are available.
8. RELEASE FORM: The selected entrant must complete and return the Sponsor’s Declaration of Compliance and Release of Liability and Publicity Release Form (the “Form”). By completing and returning the Form, and accepting the Prize, the Winner confirms compliance with these Official Rules, acknowledges that the Prize must be accepted as awarded and cannot be substituted or transferred, releases the Sponsor, its respective affiliates, advertising and promotional agencies, the independent contest organization, and each of their respective shareholders, directors, officers, employees and agents from and against all liability in connection with the Contest and/or the awarding and use/misuse of the Prize, and consents to the use of his/her name, address (city and province/territory), and/or photograph, without further notice or remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Contest. The Form must be returned within the time period specified on the Form or the Prize will be forfeited. The travel guest of the Winner and/or the parent or legal guardian if the guest is a minor in his/her province or territory of residence will be required to sign and return a Declaration of Compliance and Release of Liability and Publicity Release Form (the “Release Form”) within the time period specified on the Release Form. Upon receipt of the Form and the Release Form the Sponsor or a designated agent will contact the Winner within fourteen (14) days to begin making the necessary travel arrangements.

9.    CONDITIONS OF ENTRY: By entering the Contest, entrants (i) acknowledge compliance with these Official Rules including all eligibility requirements, and (ii) agree to be bound by the Official Rules and by the decisions of the independent contest organization and/or Sponsor, made in its sole discretion, which shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Official Rules will be disqualified.

10.  If a dispute arises regarding who submitted an on-line entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address and or profile provided at the time of entry. An “authorized account holder” is defined as the natural person who is assigned to an e-mail address and or profile by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses or profiles for the domain associated with the submitted e-mail address. An entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the Entry.

11.  GENERAL: The Sponsor and the independent contest organization do not assume any responsibility and are not responsible for: (i) the incorrect or inaccurate capture of entry information; (ii) entries which fail to comply with the Official Rules; (iii) any loss, damage, or claims caused by the awarded Prize or the Contest itself; (iv) any failure of the website during the Contest Period, including any problems, human or technical error, printing errors, lost, delayed, or garbled data or transmissions, omissions, interruption, deletion, defect or failures of any telephone or computer lines, or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail; or on-line registration to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer or other electronic devices related to or resulting from downloading any material in the Contest, all of which may affect a person’s ability to participate in the Contest; or (v) any other matter whatsoever. Registration/Entry material/data that have been tampered with or altered are void.

12.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, (i) the laws of the Province of Québec and construed in accordance with the Federal, Provincial, and Municipal laws applicable therein in respect of residents of the Province of Québec, and (ii) the laws of the Province of Ontario and construed in accordance with the Federal, Provincial, and Municipal laws applicable therein in respect of residents of the other Canadian provinces and territories, without regard to conflicts of law principles. Any attempt by a participant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. This Contest is subject to all applicable Federal, Provincial, and Municipal laws. THE PRIZE IS AWARDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES WHATSOEVER BY SPONSOR OR THE PRIZE PROVIDER, INCLUDING WITHOUT LIMITATION ANY WARRANTY AS TO MERCHANTABILITY OR FITNESS FOR INTENDED PURPOSE.

13. The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, to terminate or suspend this Contest or to amend the Official Rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, the Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, to terminate the Contest and conduct a random draw from all other eligible entries received prior to the termination of the Contest.
14. For Quebec residents, any litigation respecting the conduct and awarding of the Prize in this Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the Prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.
15. INDEMNIFICATION BY ENTRANT:  By entering the Contest, each entrant releases and holds Sponsor harmless from any and all liability for any injuries, loss or damage of any kind to the entrant, or any other person, including personal injury, death or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Contest, any breach of these Rules, or in any prize-related activity.  The entrant agrees to fully indemnify Sponsor from any and all claims by third parties relating to the Contest, without limitation.
16. INTELLECTUAL PROPERTY:  All intellectual property, including but not limited to trade-marks, trade names, designs, promotional materials, web pages, source code, drawings, illustrations, logos, slogans and representations are owned by the Sponsor and/or their respective affiliates.  All rights are reserved.  Unauthorized copying or use of any copyrighted materials or intellectual property without the express written consent of its owner is strictly prohibited.
17. CONSENT TO USE PERSONAL INFORMATION: When you voluntarily choose to register electronically to participate in the Contest, personal information including, but not limited to e-mail address, first name, last name, city, province, postal code, and home phone number (collectively “entry  information") will be collected from you by the Sponsor. By entering this Contest electronically and providing your information, you only consent and agree to: the Sponsors' collection and use of the entry information to administer this Contest, unless you have consented to receive future marketing and promotional information from in accordance with McCains Foods Limited Privacy Policy at /_layouts/McCainWongWingPromo/PrivacyPolicy.aspx?lang=en-ca.  McCains Foods Limited will only use your personal information for the purpose of the Contest, unless you have consented to receive future marketing and promotional information.

18.         CONTEST WINNER:  The name of the contest winner will be posted on or about April 15, 2012 for a period of no less than four (4) weeks at www.wongwingpromo.ca. No correspondence pertaining to the Contest will be entered into except with selected entrant and winner.
